Justices take up heart of health care overhaul law

(AP) ? The Supreme Court is taking up the key question in the challenge to President Barack Obama's historic health care overhaul: Can the government force people to carry insurance or pay a penalty?

The justices hear extended arguments on that topic Tuesday. It's the linchpin of the law's aim to get medical insurance to an additional 30 million people, at a reasonable cost to private insurers and state governments.

Virtually every American will be affected by the outcome, due this summer in the heat of the presidential and congressional election campaigns.

The administration says Congress has ample authority to impose the requirement that most people carry insurance or pay a penalty. Twenty-six states and a small business group trying to get the law struck down call the insurance requirement an unprecedented power grab by Congress.

They say that not even decades of high court rulings that endorsed an expansive view of congressional authority can support the health care law.

If upheld, the law will force dramatic changes in the way insurance companies do business, including forbidding them from denying coverage due to pre-existing medical conditions and limiting how much they can charge older people.

The law envisions that insurers will be able to accommodate older and sicker people without facing financial ruin because its most disputed element, the insurance requirement, will provide insurance companies with more premiums from healthy people to cover their increased costs of care.

White House press secretary Jay Carney, traveling Tuesday with Obama in South Korea, reiterated the administration's contention that the health care law is constitutional, noting that the individual mandate provision had support among Republicans. However, Carney said, "The president feels that this is something for the court to decide, not for us to weigh in on directly."

The law also dramatically expands the state-federal Medicaid program for low-income Americans, with the federal government covering almost all the additional costs.

A 19th century law bars tax disputes from being heard in the courts before the taxes have been paid. The law could apply to the health care case because the insurance requirement doesn't kick in until 2014 and any penalties will be paid along with federal income tax on returns due by April 2015.

Solicitor General Donald Verrilli Jr., defending the health law, urged the court to focus on what he called "the issues of great moment" at the heart of the case. The states and the National Federation of Independent Business also want the court to go ahead and decide on the law's constitutionality without delay.

Administration officials involved with the defense and implementation of the health care law, Attorney General Eric Holder and Health and Human Services Secretary Kathleen Sebelius, were in the courtroom Monday. Republican Sen. Jeff Sessions of Alabama and Florida Attorney General Pam Bondi also were in the crowd that filled the courtroom's 400 seats.

Outside the packed courtroom, marching and singing demonstrators on both sides ? including doctors in white coats, a Republican presidential candidate and even a brass quartet ? voiced their eagerness for the court to either uphold or throw out the largest expansion in the nation's social safety net since Medicare was enacted in 1965.

Republican presidential candidate Rick Santorum declared anew that GOP front-runner Mitt Romney has no standing to challenge Obama on the law since Massachusetts passed a somewhat similar version when Romney was governor. "If you really want Obamacare repealed," Santorum said outside the court, "there's only one person who can make that happen."

Later Monday, Romney said again he would repeal the law, calling it an unconstitutional power grab.

Trayvon Martin 'Could've Been Either Of Our Children,' Young Jeezy Says

The hip-hop community has been particularly vocal about the tragic shooting death of . ?uestlove, Big Boi and Wyclef Jean, like so many other Americans, have spoken out in the support of the 17-year-old boy who was murdered while walking home through a gated Florida community. During an interview with MTV News in Las Vegas on Wednesday, Young Jeezy expressed both his concern and support with equal vigor.

"I feel very deeply as a community leader and as a product of my culture," the self-proclaimed Thug Motivator said. "I feel like we all got to get together and stop this, 'cause I have a son his age and I just feel like that could've been either of our children."

Martin was walking from the store to his dad's home in the Sanford, Florida, gated community on February 26 when he was spotted by community watchman George Zimmerman. According to reports, Zimmerman, who was suspicious of the teen who was wearing a hooded sweatshirt, called 911, but was instructed by the dispatcher not to pursue Martin. By the time police arrived on the scene, Zimmerman had shot Trayvon dead and claimed self-defense.

Police did not arrest Zimmerman, who they claim is protected by the so-called "Stand Your Ground" law, which allows Floridians to shoot anyone they believe is threatening them. Martin, however, did not have a weapon. All police found on his body was a bag of Skittles, a can of iced tea and a cellphone. On Thursday (March 22), the Sanford police chief announced that he was temporarily stepping down due to overwhelming pressure from the case.

On Wednesday in New York City, demonstrators flooded Union Square in support of Martin in what was dubbed the Million Hoodie March.

The tragic incident has forced Jeezy to think about his own children. "My son is a good kid. Does he do stuff? Of course, that's what kids do. But nobody's child should be shot in cold blood for anything, especially if they didn't harm or hurt another individual," he said.

The fact that Martin is black and Zimmerman is Hispanic has added a racial sting to the killing, but Jeezy downplayed the racial element and called for unity. "I feel the racial line and the tension of it, I get it, but we're gonna stand strong on the black and the brown side on this one," he said. "We're gonna stand together. I betcha that."

The Snowman urges that everyone lend their voice because there is a bigger societal issue at hand. "This is real, I understand that there are a lot of things goin' on in the world and times are hard for everybody right now, but when you start having adults kill children for any reason, then we're on our way to something we don't want to be at," he said. "The minute we accept that, we stand for nothing."

One thing is for sure is that Google will work hard to get to the top and they will put in a huge effort. They have proven themselves as fierce competitors over and over again in many large markets so there is no reason why they can?t be competitive in this market.

One thing Google may want to try is to offer something that the other social networking sites don?t offer. If they can have uniqueness about their website it can attract many members. If you have not heard of Orkut or aren?t using Orkut then you should go to their website and see what it?s all about. If you already have a Gmail or other Google account then you are half way through the registration process already. This will certainly be tough competition for those social networking sites so it is one that is worth checking out.

There is no better measure of Chinese officialdom?s control-freakery than Prime Minister Wen Jiabao?s encounter with the press at the close of the annual meeting of the National People's Congress, China?s ersatz parliament.

This year?s performance, like last year, and the year before, was a grand set-piece event. Several hundred journalists gathered in a gaudily pillared reception room in the Great Hall of the People, photographers clicked madly whenever Mr. Wen made a photogenic gesture, and we all went through the motions of a press conference.

But if you thought the rubber-stamp National Press Club sessions were scripted, you should have been at the press event. Every question asked had been solicited, negotiated, and approved by Chinese officials. If you had not been through that process, there was no point in putting your hand up.

Chinese state-run media, whose reporters always get a chance to ask a question, can be trusted to serve up softballs. The official news agency Xinhua, for example, opened the proceedings today with a less-than-challenging request that Wen ?evaluate your work? since he took office nine years ago.

Foreign reporters generally make more of an effort to elicit something other than pabulum, but they can do so only if they play by the rules. And that means submitting questions in advance and negotiating their wording so as not to give offense.?

This can take several days of back and forth, and frankly I wonder whether it is worth it.

Foreign journalists asked Wen questions on sensitive topics such as when China would allow direct competitive elections to its national leadership, the recent spate of self-immolations by Tibetan monks, and China?s controversial refusal to back Western policies toward Syria.

But since the prime minister had seen the questions in advance, he and his aides had had plenty of time to formulate bland and unexceptional answers to all of them.

Luckily for us, though, at the end of the three-hour press conference at which the didactic Wen took an average of 13 minutes to answer a question, a cheeky Reuters correspondent ducked the rules. He asked the question that he had flagged in advance ? an anodyne inquiry about the level of local government debt ? and then snuck in a second question about a disgraced police chief who has sparked a scandal that has embroiled one of China?s most high-profile politicians, Bo Xilai.(?read more about that here)

Wen took the question, and he gave a newsworthy answer. It did not seem that hard, or painful for him. Why, we were left wondering, can he not do that all the time??

Iran sanctions seen spurring more Saudi oil sales to U.S.

NEW YORK/LONDON (Reuters) - Saudi Arabia is preparing to extend this year's unexpected jump in oil sales to the United States, adding to speculation about the response of the world's top oil exporter to sanctions against Iran and a rally in prices.

The Kingdom's shipments to the United States have quietly risen 25 percent to the highest level since mid-2008, according to preliminary U.S. government data, a sizeable leap that appears at least partly related to the imminent completion of a major expansion at its joint-venture refinery in Texas.

But some say the scale of the increase, plus other U.S. data showing Gulf Coast inventories are still subdued, suggest the potential for a political dimension as well, evoking comparisons to 2008 when the OPEC kingpin was driving up production to knock oil prices off record highs near $150 a barrel.

The surge appears set to continue. Vela, Saudi Arabia's state oil tanker company, has booked at least nine very large crude carriers (VLCCs) capable of carrying 2 million barrels of crude each from the Middle East Gulf to the U.S. Gulf since the start of March, the biggest such wave of fixtures in years, analysts say.

The pivot to the U.S. market, which bore the brunt of Saudi output curbs after 2008, is a surprise for two reasons.

For one, many analysts had believed that the kingdom's modest output increase in recent months was bound for fast-growing Asian markets, particularly given the pressure on refiners there to reduce their imports from Iran.

Plus it comes after a year in which U.S. crude oil imports shrank to their lowest since 1999 thanks to a dramatic boom in shale oil production and tepid demand from consumers who are making every effort to cut back as gasoline prices rise.

The White House has been scrambling for options to bring down gasoline prices -- at a seasonal record high -- during an election year, after concerns over an Iranian supply disruption launched benchmark Brent crude to lofty peaks over $120 a barrel not seen since the record price run of 2008.

Washington has urged ally Saudi Arabia to cover potential shortages when new U.S. and European Union sanctions are expected to reduce Iranian oil exports from July. The Obama administration has considered releasing strategic oil inventories, potentially as part of a bilateral deal with Britain.

The kingdom has stepped up efforts this week to assure edgy markets that it will make up for any oil supply disruptions at a time when Iran's standoff with the West has begun to intensify.

Saudi output in February was up 450,000 barrels per day (bpd)from October at its highest since August.

RISE IS SURPRISE

The build appears related, at least in part, to a massive expansion project at Saudi Arabia's 285,000-bpd Motiva Port Arthur, Texas joint-venture refinery with Shell Oil, the U.S. unit of Royal Dutch Shell.

All expansion units are expected to be in production by the end of the second quarter of this year, with the expanded refinery reaching, by the end of the year, a maximum capacity of 660,000 bpd. Motiva Enterprises began circulating feedstocks through some of the expansion units in January

Motiva declined to comment. The expansion project, budgeted at $5 billion, began in 2007, and when complete will make the refinery the largest in the United States.

"I suspect there is some seasonality to it, U.S. refiners build inventories in the first quarter and U.S. refiners start up Gulf Coast plants out of maintenance," said Jan Stuart.

"In addition, this year you have the Motiva expansion, which will buy a lot of crude," he said, adding the building up of 20 days worth of inventory could account for part of the increased Saudi shipments.

That would be equivalent to building up inventories of 7.5 million barrels, by a Reuters calculation, implying a need to build 100,000 bpd of stock over the first 10 weeks of the year.

INVENTORY BUILD

Still, crude inventories in the Gulf Coast region have not grown as much as they traditionally do during the first quarter when refiners build up stocks.

Gulf Coast stocks have risen by only 10.3 million barrels -- or roughly 140,000 bpd -- over the 10 week period, compared with 14.2 million barrels on average for the past five years, according to EIA data. The weekly data is preliminary, and more comprehensive monthly data for January is not yet available.

While the rise in Saudi output has been well charted, the fact that the lion's share of it appears destined for U.S. refiners will come as a surprise to many. Overall U.S. demand for foreign crude has ebbed this year as a boom in domestic and Canadian production reduces the need for imports.

The reversal of the key Seaway pipeline -- which will begin running from Oklahoma to Texas by July -- was expected further to temper demand for imports by helping bring more cheap crude from the Midwest to the U.S. Gulf Coast refining hub.

"We were all expecting to see U.S. imports fall for Vela, so it's a jump at a time when we are preparing for a reversal given the Seaway pipeline," one shipping source said. "It raises the question why would they need more imports?"

Omar Nokta, managing director with investment bank Dahlman Rose & Co, said in a note on Friday that it was the first time in "several years" for Vela to book so many tankers in such a short time.

RISE BEGAN IN JANUARY

Provisional weekly data from the U.S. Energy Information Administration shows that the rise in supplies began several months ago, and outpaced gains to other consumers such as China.

U.S. imports of Saudi oil hit 1.5 million bpd in the first 10 weeks of 2012, up 300,000 bpd from the fourth quarter of 2011 and marking the largest rise in shipments since the second quarter of 2003. Saudi shipments to China in January rose only 14 percent from the year before.

Total U.S. crude imports are up only 165,000 bpd in the first 10 weeks of the year versus the fourth quarter. The EIA was not immediately able to respond to requests for an explanation of the data.

The shift also could simply be the result of restoring supplies to U.S. customers whose shipments had been cut much more deeply after prices crashed four years ago.

"Up to 2008, there was definitely a much larger rise in shipments to Asia, that's where the demand was growing. The cuts that followed that were not proportionate," said a senior executive at a major Saudi oil customer.

"Now there's a degree of rebalancing."

The rise in bookings to the U.S. Gulf has also tightened tanker availabilities, helping push the average earnings for VLCCs on the benchmark Middle Gulf to Japan route -- the major market barometer -- to their highest level in over a year to $33,205 a day, Baltic Exchange data showed.

Data shows that the Saudi crude has been priced advantageously for U.S. buyers. Official selling prices (OSPs) for U.S. buyers, which are set by the state oil firm Saudi Aramco, have fallen to a deep discount versus Asian and European refiners, according to Reuters data.

The bargain rates may have encouraged a bit more crude to move West, although industry sources say the kingdom's largest customers with global refining systems have less flexibility to shift supplies between different regions than they have in the past.

Edward Morse, global head of commodities research at Citigroup, said that while the higher U.S. volumes could be due to Motiva, it may come as part of a wider effort to bring more Saudi crude to global markets as Iran concerns grow.

"I think that if you look over a longer term, the Saudis are increasing their exports to the whole world right now and not just the U.S.," Morse said.

"The Saudis are getting oil onto the market to encourage inventory building, and to show their customers they can deliver whatever is needed."

Turkey "safe haven" talk a game changer for Syria?

LONDON (Reuters) - Turkish Prime Minister Tayyip Erdogan's suggested humanitarian "buffer zone" for refugees in Syria could prove a turning point in the conflict, opening the door to foreign intervention in the year-old uprising.

Turkey has been wary of raising the prospect of military action, but with the body count rising and growing numbers of refugees crossing its borders -- some 15,000 so far, including 1,000 in the space of 24 hours on Thursday -- it is seen being pushed ever closer. Memories of 500,000 flooding onto Turkish territory from Iraq during the 1991 Gulf War are still vivid.

While there has been widespread speculation on Arab states -- particularly Qatar, United Arab Emirates and Saudi Arabia -- arming the opposition, actually sending Turkish troops into Syrian territory would be a major step. Ankara would seek cast-iron international backing for any such move.

Forces loyal to President Bashar al-Assad might voluntarily withdraw rather than face the Turkish military, but it is possible that at the very least some might remain behind to attack what could be seen as a foreign invasion force.

"If implemented, it may be a game changer," says Anthony Skinner, Middle East analyst at UK-based political risk consultancy Maplecroft. "Protecting such a zone... requires the deployment of Turkish ground forces and this will be very significant in terms of the overall security dynamic and clearly benefit the opposition."

While the stated intention of any troop deployment would be to protect refugees and allow delivery of humanitarian aid, the fledgling Free Syrian Army would almost certainly use such an area as its own safe haven. Turkish-controlled territory could become an area in which they could arm, train and potentially coordinate attacks on government forces elsewhere in Syria.

So far, the opposition has had little success seizing territory and has struggled in the face of the government's overwhelming firepower -- used to devastating effect particularly in the siege of parts of Homs.

OTHER INTERNATIONAL FORCES DRAWN IN?

With Western powers including the United States reluctantly examining their own intervention plans for Syria, any Turkish operation might find support from other NATO members. At the very least, US forces based in Turkey might well be drawn into providing logistics and intelligence support.

A true United Nations mandate for such action appears almost impossible, with Russia and China likely to block any such resolution. With Russia already providing arms and fuel to long-term ally Assad, Turkey could also find itself drawn into increasing confrontation particularly with Moscow.

"Ankara has been talking about intervention for quite some time, but unless it can secure wider international participation it remains very unlikely," said Julien Barnes-Dacey, a Middle East specialist at the European Council on Foreign Relations. "There is a definite risk that Assad could resist the move militarily, trying to make it too costly an exercise for the Turks and others to pursue."

Nevertheless, the lesson from last year's Libya war would seem to be that appetite for foreign intervention can ramp up surprisingly fast. On Friday, Tunisia said it had no objection to the idea of a buffer zone, perhaps a sign of growing support for the idea in the Arab world.

Turkey's Erdogan said the April 2 "Friends in Syria" meeting of interested Western and Middle Eastern states would come up with a "very different result" to this month's Tunisian meeting, widely seen as achieving little.

While the Libya campaign itself was no easy task, military strategists say any kind of campaign in Syria would be much more complex. Not only is the country itself and its population considerably larger, but its military is much more sophisticated than that of Muammar Gaddafi. Sophisticated air defenses would make operating drones much more difficult, while targets much further from the coast would be harder to hit.

Perhaps even more crucially, a repeat of the crippling sanctions and NATO blockade that starved Gaddafi of oil export income and vital fuel imports is rendered almost impossible by Russian and Chinese opposition.

KURDISTAN-STYLE "SAFE AREA"?

For now, opposition forces also appear much weaker than those of the early Libyan campaign where they captured much of eastern Libya relatively easily and simply required NATO air support to hold government forces back.

One potential scenario for Syria, experts say, would be a rough repeat of the "safe area" set up in the northern Iraqi region of Kurdistan in the aftermath of the 1991 Gulf War. A handful of ground troops and air power -- together with regular Turkish forces -- were able to maintain it as an independent enclave.

"Even if established, a buffer zone wouldn't immediately change the wider balance of power," said Barnes-Dacey at the European Council on Foreign Relations. "While being a significant loss to Assad and a potential area for the opposition to mobilize, (it) wouldn't threaten his hold or continued use of violence across the country at large."

With its own Kurdish minority also demanding and occasionally fighting for self-rule, Turkey has more to lose than most countries if Syria's unraveling produces a wider chaos and regional redrawing of borders. It will also worry that any weapons supplied to Kurdish groups within Syria could eventually end up being used against the Turkish state.

But the greatest impact any outside military intervention could have would be within the Syrian ruling elite itself. Already, there is growing talk of military defections including a number of senior officers fleeing to Turkey. If foreign action strengthens the narrative that Assad's time is running out, that could intensify.

"If Turkey is drawn more directly into the conflict, then Bashar al-Assad has reason to be concerned about his neck," said Maplecroft's Skinner.

If you want to save money on an HDTV, it's okay to lag a generation or so behind this year's models. While we wait for 2012 sets to hit stores, plenty of solid 2011 models are still available, and in anticipation of those new sets, their prices are getting lower and lower. The Sony KDL-46EX620 is one such HDTV. It will eventually be replaced by the Wi-Fi-equipped KDL-46EX640, but until then, it's a good-quality, inexpensive ($809.99 direct)?46-inch LED-backlit HDTV with a nice selection of online features.

Design
Plain and unassuming, the KDL-46EX620?measures a modest, not particularly thin 28.1 by 37.3 by 1.7 inches (HWD) and weighs 39.2 pounds. The bezel is flat, black, and slightly glossy, and besides a power light and the Sony logo, there are no markings on the front face of the set. The right side of the HDTV hides physical controls that let you turn the set on and off, change the channel (if using the tuner), adjust the volume, change the source, and enter the menu system. The left side of the HDTV holds an HDMI input, two USB ports, a VGA input, and a 3.5-mm audio output. The back houses the other three HDMI inputs, component and composite video inputs, optical audio output, an Ethernet port, and an F-type connector for cable or antenna.

The 8.5-inch remote is rectangular, black, and mostly flat. Its buttons are separated into Power, Input, and Playback at the top, a navigation pad surrounded by menu controls in the middle, and a number pad and Volume and Channel buttons near the bottom. The rectangular buttons in the playback and number pad areas are hard to differentiate without looking at them, but the navigation pad is large enough to use blindly. The remote isn't backlit.

Like all other connected Sony HDTVs, the 46EX620 uses Sony's attractive and intuitive XrossMediaBar (XMB) interface to arrange its various apps and services. Activities like watching TV, viewing streaming video services, listening to streaming music services, and changing settings are arranged in columns that are hidden under different icons in a horizontal bar on the bottom of the screen. The active column is shown on the right side of the screen, letting the user continue to watch the active source while navigating the menus.

Features and Performance
The 46EX620 connects to the Internet via its Ethernet port or with Sony's optional $80 UWA-BR100 Wi-Fi USB adapter. Once connected, you can access Netflix, Hulu Plus, and a wide selection of other streaming media services. A Web browser is also available on the HDTV, but inputting information with the remote is time-consuming. The HDTV also supports Skype video chat with the optional $150 CMU-BR100 webcam.

We test HDTVs using DisplayMate test patterns and a chromameter, after performing basic brightness and contrast calibrations. The 46EX620 has loads of options for tweaking your picture and making it more energy efficient, including a light sensor that adjusts the brightness of the screen based on the room lighting and several automatic black level, white level, contrast and edge adjustment features. For testing, we turned all of those measures off to determine the most effective peaks and lows of the screen's brightness and color. According to our tests, the 46EX620 gets sufficiently bright, but its black levels are a bit weak. At peak, the HDTV puts out 208.02 cd/m2 brightness, but with a dark screen it puts out 0.08 cd/m2?for a contrast ratio of 2,600:1 with the auto-darkening/brightening features disabled. This is disappointing on paper, but not much worse than the Editors' Choice Sony KD-46EX720 ($1,599.99, 4 stars), the 46EX620's bigger, 3D-capable brother, which produced a contrast ratio of 3,897:1 and showed a black level of 0.07 cd/m2 in our tests. Color temperature was excellent, with red and green remarkably close to ideal and blue running slightly warm.

Despite its mediocre black levels and contrast ratio, the 46EX620 puts out a good picture. To test, I loaded the Priest Blu-ray disc and watched some starkly lit scenes. The HDTV showed some shadow detail, but finer elements like fabric texture and objects in darkness were completely swallowed by black. Highlights fared much better, with the bright and bleak scenes showing plenty of detail across the desolate sands of the movie.

The LED-backlit 46EX620 showed solid energy efficiency in our tests. With all eco-friendly features turned off, the HDTV consumed an average of 78 watts. With the Eco feature set to Low, the picture remained very watchable while the screen consumed an average of 66 watts. Activating the other eco-friendly features like the light sensor made the screen dim unacceptably, and it doesn't quite hit the levels of the Panasonic TC-L42D30 ($1,049.99, 3.5 stars), which consumes only 36 watts, but it's still respectable.

The Sony KDL-46EX620 is a good performer with nice features, and since it's being replaced with a new Wi-Fi-equipped, yet otherwise very similar, model in the coming months, it's a great deal. The black levels and contrast ratio aren't the best we've seen, but the?46EX620 delivers on?price and features.
